Navigating Indiana Medical Cannabis Laws

Indiana does not have a comprehensive medical cannabis program. Indiana's legislative history includes House Enrolled Act 1148 (2017), which established a narrow cannabidiol registry for patients with treatment-resistant epilepsy under IC 16-42-28.6. That registry was repealed the following year by Senate Enrolled Act 52 (2018), which replaced it with a broader framework legalizing the purchase, possession, and sale of low-THC hemp extract for any person under IC 15-15-13. No patient registration system, caregiver program, or licensed dispensary network exists under current Indiana law.

Patients and their caregivers should be aware that their rights and legal protections* vary by state, age, and even the chemical composition of a product. Medical professionals have federal protections to discuss cannabis medicines with their patients, but incorporating them into their patients' treatment regimen is a very different process than writing a prescription. Laws and regulations are constantly evolving and require consistent advocacy to ensure better patient outcomes.

Background on State Laws

There is limited medical cannabis availability in Indiana. The medical program limits patients to cannabidiol oils with 0.3 percent or less THC, in compliance with USDA hemp standards. The state has authorized the production of CBD from in-state industrial hemp cultivators. Details on how these laws apply to patients and medical professionals can be found below.
