RECOMMENDING CANNABIS IN KANSAS

Kansas does not have a comprehensive or operational medical cannabis program. In 2018, the Kansas legislature passed SB 282, allowing the use of CBD products with no THC concentration, and in 2019, it passed Claire and Lola's Law, creating an affirmative defense for individuals in possession of CBD treatment preparations. These preparations are CBD-rich oils containing no more than 5% THC. |
Kansas does not have a medical cannabis program. Health care practitioners in Kansas are not authorized under state law to certify patients for medical cannabis use.
Federal Rights & Protections for Medical Professionals
Medical professionals have a legal right to recommend cannabis as a treatment in any state, as protected by the Medical Marijuana and Cannabidiol Research Expansion Act (Title III section 301) which became law on December 2, 2022, and the First Amendment (established by a 2004 United States Supreme Court decision to uphold earlier federal court rulings that doctors, and their patients have a fundamental Constitutional right to freely discuss treatment options).
