  • Congratulations on joining the Biden-Harris Administration as Attorney General.
  • My name is (say your name) and I am calling you today to ask you to reissue the Cole Memo to provide important assurances to medical cannabis businesses and patients like me who rely on them for medicine about the direction that the Biden-Harris Administration is taking on cannabis.
  • Today there are patients living in one of the 36 states where medical cannabis is legal who need medical cannabis for treatment, but must navigate a complex system of federal and state laws in order to obtain access that doesn’t really work very well without federal support.
  • These patients are seniors, veterans, people with disabilities and families, children and regular people like me who very much need your leadership to reform our federal cannabis policies to enable patients to have safe, legal, affordable and reliable cannabis medicine.
  • While much broader and deeper reforms from DOJ are needed, particularly related to the DEA, an important first step and signal to state-licensed medical cannabis businesses and patients would be to update and reissue the Cole Memo.
  • This memo, rescinded by the Department in 2108, provided assurance to compliant state-licensed medical cannabis businesses and the patients who rely on them for cultivation, manufacturing, lab testing, distribution and retail of cannabis medicine, that businesses could continue operating and patients could count on maintaining important medical access so long as the guidance was in place.
  • Restoring the Cole Memo will again reassure compliant medical cannabis businesses, the patients who rely on them for medicine, and financial institutions about the federal approach to cannabis, encourage service of the legal cannabis industry, and increase the safety and transparency of an industry that must still largely operate in cash.
  • For these reasons I ask that you reinstate the Cole Memo as an interim step to formal DOJ rulemaking on medical cannabis.
