Amendment 2, the Florida Right to Medical Marijuana Initiative, would create a statewide medical marijuana production and distribution system that would be licensed and regulated by the Florida Department of Health (DOH). The program created would establish a state constitutional right for physicians to recommend medical marijuana to any patient for whom they feel the benefits of marijuana therapy would outweigh the potential risks. Patients with a written recommendation would then be able to register with DOH and purchase medicine from Medical Marijuana Treatment Centers. Patients could also apply to have a designated caregiver assist them with the acquisition and administration of medical marijuana. These centers would be licensed and regulated by DOH and would cultivate, process and sell medical marijuana and related products, such as edibles, oils, ointments, and tinctures. Under Amendment 2, if DOH fails to begin issuing patient registration ID cards to qualifying applicants within nine months after the effective date, patients may seek judicial relief to gain access and legal protections.
