Adult Use Ballot Measure: California Proposition 64, Marijuana Legalization

ASA Position: Neutral

California’s Proposition 64, the Adult Use of Marijuana Act, will legalize possession of up to one ounce of cannabis or eight grams of concentrates and cultivation of up to six plant for adults who are twenty-one years old or older. ASA’s mission is focused exclusively on medical cannabis; and therefore, the organization generally does not take positions of support or opposition regarding adult-use (aka "recreational") marijuana laws. The initiative also establishes a comprehensive licensing and regulatory framework for cannabis businesses that parallels the newly adopted medical cannabis laws in the state. Proposition 64 imposes a 15% excise tax on cannabis and medical cannabis. The voter initiative leaves California’s landmark Compassionate Use Act (Proposition 215) intact. New protections for medical cannabis patients include (1) exempting patients with an ID card from currently applicable sales tax, (2) protecting patients from discrimination in parental rights, (3) prohibiting cities and counties from banning indoor cultivation of up to six plants and (4) increasing patient privacy standards.
