Medical Marijuana User Ordered To Retake Driver's License Test

SACRAMENTO, Calif. -- A medical marijuana user in California is complaining that the state is singling her out by ordering her to re-take a driver's license test.

Diane Monson takes the drug to help her cope with back pains and is one of the plaintiffs in a case before the Supreme Court examining the issue.

She was told this month she had been selected for re-examination. The Department of Motor Vehicles has postponed the test, and officials say they are doing a "top to bottom" internal review of the case.

The state routinely re-tests drivers who have had serious accidents or multiple drug and alcohol convictions. However, Monson said her only infraction was a speeding ticket.

Her lawyer said she was singled out for her views.
