Medical Marijuana Case Back In Court

Less than a year after the U.S. Supreme Court ruled against her an Oakland woman is renewing her fight Monday to legally smoke marijuana.


Angel Raich will go back before a federal appeals court in Pasadena with a different legal argument.


Her lawyers will try to persuade a three-judge panel that keeping her from using medical marijuana unduly burdens her fundamental rights to life and freedom from pain.


The U.S. Supreme Court ruled last June that federal laws outlawing marijuana apply to California and other states that have passed medical marijuana laws.
