Judge bars Atascadero from closing medical marijuana dispensary

A Superior Court judge this morning granted a temporary restraining order barring the City of Atascadero from shutting down a controversial medical marijuana dispensary.
Charles Lynch, owner of Central Coast Compassionate Caregivers, was ordered to close the business Jan. 24 while city staff craft an ordinance that would govern cannabis cooperatives in the city limits. Judge Martin J. Tangeman?s ruling allows Lynch to continue operating through a Feb. 17 hearing, during which city attorneys must show cause for the shut down.
Louis Koory, Lynch?s lawyer, has argued that the city can not retroactively enforce any new policy staffers may create.
The business remained closed this week after receiving an official shut-down order last Friday, Koory said.
