Council revisits medical marijuana dispensaries

Milpitas City Council will decide what avenue to follow regarding medical marijuana dispensaries that want to locate in the city of Milpitas, at its meeting Tuesday.

At the May 17 meeting, the council voted down an emergency moratorium temporarily banning such facilities by a 3-1 vote, with Councilmember Althea Polanski casting the lone vote in opposition (the issue needed four positive votes).

Now, city staff is asking direction about how to proceed, and offering two options.

Staff could draft a zoning ordinance amendment temporarily prohibiting medical marijuana dispensaries for up to one year to allow staff to study secondary effects, current law and regulation, business models and existing city ordinances and implementation plans. Staff could also draft an ordinance regulating medical marijuana dispensaries in Milpitas.

The meeting will occur June 7 at 7 p.m. at Milpitas City Hall, 455 E. Calaveras Blvd.
