Teague Medical MJ Case Heads Towards Appeal

ORANGE COUNTY - The case of Prop 215 patient Michael Teague, who was charged with a federal gun violation as well as marijuana cultivation after his case was dismissed in state court, was steered towards the Ninth Circuit Court of Appeals at hearings by US District Court David O. Carter last Friday, Feb. 7.
Teague received a bench trial; a jury trial trial was waived to avoid a higher sentence and preserve his right to appeal. The bogus gun charge (being an unlawful drug user in possession of a firearm) was dropped, leaving only the cultivation charges. He will be sentenced Jun 9th, and his attorney, David Nick, will enter an appeal. "The judge was outstanding and saw this case for what it was," said Teague's mother, Anita. Judge Carter also presided over Steve McWilliams' favorable plea settlement - an exhibit of sanity on the federal bench, in contrast to the DOJ. The judge allowed Mike to stay out of jail until Jun 9th. "There was a whole group of federal people against David Nick but David did an outstanding job," said Anita, "We really had no surprises, just very thankful Mike was allowed to stay free until later."
